These terms of use (together with the documents referred to in it – collectively referred to as the “Terms”) sets out the terms of use you may make of the APL website [Insert URL] (“Website”).

Please read these terms of use carefully before you start using the Website, as they will apply to your use of the Website. By using the Website (including registrations, payments and donations made through the Website), you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use the Website.

The Website is operated by APL (“we” or “our”) located at 35 Cromwell road, London SW7 2DG.

1. Definitions

In these Terms, the following words shall have the following meaning:

  • APL” means l’Association des Parents d’Eleves du Lycée, which represents the parents’ interests vis-à-vis the teachers, the Lycee’s administration and other official bodies;
  • Lycée” means the Lycee Francais Charles de Gaulle in London with its four sites of South Kensington, Marie d Orliac, Wix and Andre Malraux;
  • APL Welfare Fund” means the charity registered under number 1082875;
  • Friends of the Lycée” means the charity registered under number 1000639;
  • Material” means all of the information, data, text, graphics, links or computer code published on, contained or available on the Website including the APL name and logo;
  • User” or “you” means any individual, company or otherwise accessing the Website or making a payment or a donation through the Website.

 2. Accessing the website

The Website is made available free of charge. We do not guarantee that the Website or the Material will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the Website.

3. Use of the website

Any information accessed through the Website may be used for your personal use only and not for reproduction on any other website or for commercial gain.
Any link created to the Website must be notified to, and approved by, APL before it is created.

4. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in the Website and in the Materials published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from the Website for your personal use and you may draw the attention of others within your organization to the Material.  Our status (and that of any identified contributors) as the authors of the Material must always be acknowledged.

You must not use the Material or any part of it as displayed on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of the Website in breach of these Terms, your right to use the Website will cease immediately and your must, at our option, return or destroy any copies of the Materials you have made.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

We exclude all liability to any person for any loss or damage, whether in contract, tort (including without limit negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or relating to (i) the use of any Material or the provision of any goods or services through the Website or (ii) the use of or reliance on any content displayed on the Website.

To the extent permitted by law, we exclude all warranties, representations, conditions or other terms which may apply to  the Material and any goods or services supplied through the Website, whether express or implied.

The Website may contain links to websites operated by third parties. Such links, if any, are provided for your information only. We assume no responsibility for the content of any such websites. The inclusion of such links should not be interpreted as endorsement by us of any material on such websites or any association with the operators of such websites. We will not be liable for any loss or damage that may arise from your use of them.

8. Viruses

Whilst we makes reasonable efforts to exclude viruses from the Website, we do not guarantee that the Website will be secure or free from bugs or viruses and we will not be liable for any loss or damage caused to you as a result of viruses downloaded through the Website.

9. Registration and Online Donations

APL yearly registration fee , which currently amounts to £15, may be paid on-line through the Website. Once paid, that fee is non-refundable.
Any subscription by a User to the CGEA insurance through the Website can be cancelled by the User for any reason within fourteen days upon prior notice to APL. In this case, APL will refund within 30 days the relevant subscription in full. If you wish to cancel your CGEA insurance subscription at any time, please let us know.
APL reserves the right to vary its registration fee with prior notice. APL reserves the right to refuse to accept any registration to any User.
Any donation made by a User to APL Welfare Fund and/or Friends of the Lycee on-line via the Website is non-refundable. As registered charities, APL Welfare Fund and Friends of the Lycee are able to reclaim tax from HMRC at no extra cost to you, if you are a UK tax payer. All you need to do is complete the Gift Aid declaration. If you are a higher rate tax payer you can yourself reclaim the difference between the higher rate and the basic rate on your tax return, thereby reducing the cost of their gift.

10. Encryption

Although the Website uses encryption security software in areas where on-line payment details are accepted, the security of information and payments transmitted via the Internet cannot be guaranteed. Any loss incurred or sustained by any User who transmits information or payment by means of e-mail or other internet links shall be borne solely and exclusively by such User and in no event shall any such loss in whole or part be borne by APL or its agents.

11. General

If any provisions of these Terms are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected. These Terms constitute the entire agreement between APL and the User and supersede all other communications and proposals, whether electronic or written, between the User and APL. Any failure of APL to exercise or enforce any of its rights under these Terms shall not constitute a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement of any such rights.

12. Applicable Law and Jurisdiction

The Terms, their subject matter and contract formation based on them are governed by the laws of England and Wales and the parties hereto agree that  the English courts have exclusive jurisdiction (save that we may instigate proceedings for injunctive relief in any jurisdiction).

13. Changes to the Website or these Terms

We may update the Website from time to time, and may change the content at any time. However, please note that any of the content on the Website may be out of date at any given time, and we are under no obligation to update it.
APL may, at its sole discretion, modify these Terms at any time by amending this page and such change shall be effective immediately. Please check this page from time to time to take notice of any changes we made, as they are binding on you.

This Privacy Statement is made in light of the requirements of the Data Protection Act 1998 and describes how the Association des Parents d’Eleves du Lycee (“APL” or “we”) collects, uses, and discloses certain personal information obtained through our website www.apl-cdg.org.uk (the “Website”).
